RE: Vote on March 18 on the proposal to establish a Telecommunications Single Market

I write on behalf of the European Consumer Organisation (BEUC) to express our views on the draft report on the proposal for a regulation to establish a Telecommunications Single Market which is subject to vote on March 18 in the ITRE Committee.

Protecting consumers’ right to access the open internet

Protecting the right to access the open internet is protecting the internet itself, as the only way to ensure it remains open and neutral. Legal certainty is served by setting out on the one hand the rights attributed to end-users and on the other the obligations this implies on telecom operators. The provision of pecialised services shall exist with strict safeguards in place to protect undue influence on the quality and openness of internet access services. Furthermore, internet content should be served over the internet. We are concerned that some of the proposed amendments would pave the way for the kind of preferential discrimination that will endanger the open and innovative characteristics of the internet.

BEUC supports CA4B and AM559D.

If CA4B falls, then we call on you to reject CA4A,

Creating a true Single Market for all European consumers

From a consumer perspective, services such as phone calls, SMS and access to the internet should be usable seamlessly across the EU, without any geographical discrimination. There are two sides to this coin: when the consumer is home and wants to connect with someone in a different Member State (Article 21) and when the consumer is travelling within the EU (roaming).

Seeking to abolish any type of discriminatory practices is very important for the creation of a true Single Market for consumers. The prohibition of price

differentiation based on the geographical origin and destination of a service is an adequate approach, and telecom providers should therefore never be allowed to have differentiated access or pricing policies, unless there are unavoidable and ignificant additional costs which need to be covered to offer the service.

In addition, wholesale caps must also be reduced in order to ensure there is healthy competition between roaming providers, and market challengers get a fair chance to access consumers.

Roaming: BEUC supports Compromise Amendment 2.

Article 21: BEUC supports amendments 576 and REGI8. BEUC rejects amendments 68D, 101D, 573D.

Entry into force

When a final agreement is reached on this Regulation, all parts of it should enter into force at the same time. The European Commission’s proposal foresees a 2 year delay in the entry into force of Chapter IV on end-user rights, which is unacceptable.

BEUC supports amendment 151D.
