THE TOBACCO PRODUCTS DIRECTIVE COMPROMISE
ON ELECTRONIC CIGARETTES (AM 190)

Dear Members of the European Parliament,
During the final trilogue of 16 December 2013, the European Parliament and the Council of the EU reached an inter-institutional agreement to regulate electronic cigarettes within the framework of the Tobacco Products Directive (TPD) under its Article 18. The co-legislators decided that a less harmful alternative to conventional tobacco must be available to European citizens and comply with strict quality and safety standards. This agreement is the outcome of complex negotiations in which the Parliament decisively defended the rights and interests of European citizens, while understandably accepting certain compromises. The Tobacco Vapor Electronic Cigarette Association (TVECA), together with the electronic cigarette national associations of the Czech Republic (KELK), Germany (VdeH), Greece (SEEHT), Italy (ANAFE), Netherlands (Esigbond), Poland (STEP) and Spain (ANCE), has led the most representative Industry Coalition and since the very outset of the process has been working hand-in-hand with the European Parliament, Member States and the Commission to ensure that smokers have access to a less harmful alternative to conventional tobacco products while meeting the highest quality and safety standards. Precisely because we have been involved since the beginning of the process, we understand how difficult it has been to reach the current agreement. Understandably, certain provisions of the text may pose challenges to the e-cigarettes industry, including some of the scientific requirements. However, letting such a rapidly growing sector unregulated any longer is neither an option for responsible industry nor to policy makers. This is why the TVECA-led Industry Coalition publicly supports the interinstitutional agreement under the TPD as the best possible alternative under the current circumstances. Tomorrow, Wednesday 26 February, you will be deciding on whether to support the workable compromise European Parliament and Council of the EU have reached on this very important matter. On behalf of the Industry Coalition, we strongly encourage you to support AM 190.
Once the TPD is adopted, we will certainly continue the constructive collaboration with Member States and the European Commission during the implementation process to ensure that the new Directive achieves its objectives. As a responsible industry, we look forward to contributing to the success story of the first-ever ecigarettes legislation in Europe. We thank you for your time and support on this important dossier.
